DMCA Policy

FanCut respects the intellectual property rights of others and responds promptly to valid DMCA takedown requests. This policy outlines our procedures for addressing copyright infringement claims.

1. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been used on FanCut without authorization, please submit a DMCA notice to our designated agent:

Your notice must include:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on FanCut (URL)
• Your contact information (email, phone, address)
• A statement that you have a good faith belief that the use is unauthorized
• A statement that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

2. Our Response to Valid DMCA Notices

• We will promptly remove or disable access to allegedly infringing content upon receipt of a valid notice
• We will notify the user who posted the content that it has been removed
• Repeat infringers will have their accounts terminated

3. Filing a Counter-Notice

If you believe your content was removed in error or that you have the right to use the material, you may submit a counter-notice to dmca@fancut.app.

Your counter-notice must include:

• Your physical or electronic signature
• Identification of the removed material and its previous location
• A statement under penalty of perjury that you have a good faith belief the material was removed in error
• Your name, address, phone number, and consent to jurisdiction

4. Fair Use and Transformative Works

FanCut supports transformative works and fair use under copyright law. Many user submissions may qualify as fair use, including:

• Commentary and criticism
• Parody and satire
• Transformative creative expression
• Educational or informational content

Before filing a DMCA notice, please consider whether the content constitutes fair use. Misrepresenting that content is infringing when it is protected by fair use may result in legal liability.

5. Repeat Infringer Policy

FanCut maintains a policy of terminating accounts of users who repeatedly infringe on the intellectual property rights of others.

6. Misrepresentations

Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing may be subject to liability for damages.
